Do I Have to Change My Name After I Get Married?

So… Do I Have to Change My Name After I Get Married?

It’s a question you’ve probably stumbled upon when you’re talking about your wedding. I’ve found some couples ask me this sometimes weeks before the wedding, sometimes the day after. You’re riding the emotional high of saying “I do,” and then suddenly…Hey, do I change my name? Can I? Should I? How?

You start Googling.

Do I have to change my name after marriage in Australia?

Is it automatic?

What documents do I need to update?

What if I want a completely new last name?

The truth is, there’s a lot of outdated or unclear advice out there. So let’s cut through the confusion and give you the real story, straight from a registered celebrant who’s helped hundreds of couples figure it out.

Do I Have to Change My Name After Marriage?

Not at all. Changing your name after marriage is 100% optional. It’s a personal decision, and there might be cultural reasons, but you’re not legally required to change it. In fact, some couples don’t.

You have a few options:

  • Keep your current surname
  • Take your partner’s surname
  • Hyphenate both surnames
  • Create a new surname (which requires a legal name change)

There’s no single right way. The only right choice is what you feel is true to you.

Does My Name Automatically Change on the Marriage Certificate?

Simple Answer. No. It doesn’t.

Your marriage certificate will show the names you and your partner used at the time of your marriage. Like a snapshot of you right there and then at that moment in time. It won’t display any new name you may choose to adopt.

That means if you want to start using a different surname after marriage, you’ll need to take some steps to make it official.

How Do I Change My Name After Marriage?

This is where a lot of people get confused. Here’s the process:

  1. Apply for your official marriage certificate from the Registry of Births, Deaths and Marriages (BDM) in your state or territory. This is important. This certificate isn’t the commemorative certificate you receive on the day. You’ll need the official document issued after registration.
  2. Use that official certificate to update your name with each organisation, like:
    • Passport office
    • Driver’s licence and RMS
    • Medicare
    • Banks and super funds
    • Insurance providers
    • Utilities, phone companies, etc.

Dealing with all this life admin can be pretty overwhelming. Just keep in mind that each organisation has its own way of doing things, so you’ll probably need to fill out a few forms and show some ID. But the good news is that once it’s done, you won’t have to change it again!

Is There a Deadline?

Nope. You can change your name straight after the wedding or ten years later. It’s entirely up to you. Just keep in mind that the longer you wait, the more documents you’ll need to update once you do decide to go through with it.

Can I Just Start Using My Partner’s Name Without Updating My ID?

Socially, yes. Officially, no.

You’re welcome to intro yourself however you like. But if you want to use your new name on legal documents such as passports, licenses, tax files, you’ll need to go through the correct process using your official marriage certificate.

Ok, But What If We Want to Create a New Surname?

Let’s say you and your partner want to combine your surnames or invent a new one entirely. Or you have sometime completely different in mind. To do this, you’ll need to apply for a legal name change through the BDM in your state or territory. This is a separate process from the standard post-marriage update and involves extra paperwork and fees.
